Model Distance Contract

Model Distance Contract 

 

The Seller offering merchandise on SIA ISTOCK online marketplace, hereinafter referred to as the Seller, of the first part, and the person who placed an order, hereinafter referred to as the Buyer, of the second part, hereby enter into the following Agreement: The Seller undertakes to sell and deliver merchandise to the Buyer as per the Buyer’s order. 

 

Delivery and Payment 

 

The Buyer orders merchandise on this website, specifying the type and amount of ordered merchandise. The Buyer can pay for merchandise by using payment methods built-in on the online marketplace or by paying an invoice issued and sent by the Seller to the Buyer via e-mail. The invoice is issued electronically and valid without signature. 

 

The Seller ensures merchandise is delivered to Europe within 1 to 3 business days (if merchandise is available at the warehouse) upon receipt of payment for merchandise, by negotiating the time of delivery with the Buyer. 

 

Right to Reject 

 

The Buyer may reject Merchandise within 14 calendar days upon receipt of Merchandise, by sending the Seller a letter of rejection. Upon request of the Buyer, the Seller sends the Buyer a rejection form via e-mail. 

 

The Buyer shall return merchandise to the Seller within 7 days upon dispatch of the letter of rejection. The Buyer shall incur all costs and expenses, resulting from the return of merchandise to the Seller. 

 

The Buyer may not exercise the right of return, if: 

 

  • ordered merchandise is made-to-order for the Buyer; 

  • merchandise bears the signs of use. 

 

Part 6 of Section 12 of the Consumer Rights Protection Law of the Latvian Republic (Patērētāju tiesību aizsardzības likums) says that “the consumer shall maintain the quality and safety of merchandise as he or she exercises the right to reject.” The Seller reserves the right to deny the Buyer the right of return or withhold a compensation in the case of merchandise damage, negligent handling of merchandise during its use or a failure to comply with directions for use, if the original package of merchandise is lost or badly damaged. 

 

Data Processing 

 

By entering necessary information during the order placement, the Buyer acknowledges that he or she has read and agreed that data he or she provided will be used for the Seller to accept the Buyer’s order and deliver merchandise in accordance with the law of the Latvian Republic. By entering information, the Buyer agrees that notices relating to processing of the Buyer’s order will be sent to the said e-mail.
